Overview
18 U.S.C. § 2257 and 28 C.F.R. Part 75 require certain producers of visual depictions of actual or simulated sexually explicit conduct to maintain records regarding the identity and age of performers.
TheOtherBoard ("we," "our," or the "Platform") is committed to complying with all applicable federal and state laws, including those regarding age verification and record keeping requirements.
Exemption Statement
TheOtherBoard operates as a platform for user-generated content. We assert that:
Primary Exemptions
The visual depictions contained on this website are exempt from the provisions of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for one or more of the following reasons:
- The visual depictions do not portray actual sexually explicit conduct as specifically defined in 18 U.S.C. § 2256(2)(A)
- The visual depictions do not include depictions of the genitals or pubic area created after July 27, 2006
- The visual depictions do not portray simulated sexually explicit activity as defined under the statute
- The visual depictions were created prior to July 3, 1995
Platform Role
TheOtherBoard functions as an advertising platform and does not produce the content posted by users. Users who post content are solely responsible for their compliance with all applicable laws.
Age Verification
We take age verification seriously:
- User Declaration: All users must affirm they are at least 21 years of age when registering
- Provider Verification: Providers undergo verification to confirm they are adults legally permitted to advertise
- Content Standards: All persons depicted in user-submitted images must be 18 years of age or older at the time the images were created
Zero Tolerance
We have a zero tolerance policy for any content depicting minors. Any such content will be immediately removed and reported to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement agencies.
User Responsibility
Users who upload content to the Platform represent and warrant that:
- All individuals depicted in any uploaded images are at least 18 years of age
- They have obtained all necessary permissions and releases for any images uploaded
- They maintain any records required by 18 U.S.C. § 2257 if applicable to their content
- The content does not violate any federal, state, or local laws
By uploading content, users agree to indemnify and hold harmless TheOtherBoard from any claims arising from their content.
Platform Role and Limitations
TheOtherBoard's role is limited to:
- Transmission, storage, retrieval, and hosting of user-submitted content
- Formatting and displaying content on the Platform
- Providing tools for users to manage their own content
We do not produce, direct, or create the content posted by users. As such, we do not maintain 2257 records for user-generated content but require users to comply with all applicable laws.
Reporting Non-Compliant Content
If you become aware of any content on the Platform that you believe may violate 18 U.S.C. § 2257 or involves individuals who may be under 18 years of age, please report it immediately:
