We accept notices in English only. For non-legal matters, please use the contact form instead — using the legal channel for general support slows down the people who need it.
DMCA takedown notices
TheOtherBoard respects intellectual property rights and responds to properly-formatted Digital Millennium Copyright Act (DMCA) takedown notices. If you believe content on the Platform infringes your copyright, send a notice that includes everything we need to act on it.
What a valid DMCA notice must include
- Your physical or electronic signature (or the signature of the rights-holder's authorized agent)
- Identification of the copyrighted work you say has been infringed — if multiple works, a representative list is fine
- Identification of the infringing material with enough detail for us to find it (URLs are best)
- Your contact information: name, postal address, telephone, email
- A good-faith statement that the use is not authorized by the rights-holder, its agent, or the law
- A statement under penalty of perjury that the information above is accurate and that you are authorized to act on behalf of the rights-holder
Section 512(f) penalty
Knowingly materially misrepresenting that material is infringing may subject you to liability for damages, including costs and attorneys' fees. If you're unsure, talk to a lawyer before filing.
Counter-notification
If your content was removed and you believe it was a mistake, you can send a counter-notice. It must include:
- Your physical or electronic signature
- Identification of the material that was removed and where it appeared before removal
- A statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the Federal District Court for the district in which you are located (or the State of Wyoming if you are outside the United States), and that you will accept service of process from the complainant
What happens next
- We forward your counter-notice to the original complainant.
- The complainant has 10 business days to notify us of legal action.
- If no legal action is filed, we may restore the removed content within 10–14 business days.
Repeat-infringer policy
We terminate accounts of users we deem to be repeat infringers in appropriate circumstances. Our usual escalation:
- First strike: warning issued, content removed.
- Second strike: account suspended for 30 days, content removed.
- Third strike: permanent account termination.
We reserve the right to terminate any account for egregious violations regardless of prior strikes.
Good faith
We process notices in good faith and we encourage parties to try to resolve disputes before filing formal notices. Filing a false notice or counter-notice can result in legal liability.
